Road Infrastructure Development – Enhancing Connectivity and Accessibility:

- Last Date and Time for Tender Form Submission: March 03, 2025, 12:00 PM (Noon). Sealed bids must be submitted no later than this deadline at the designated location. Late submissions will not be accepted under any circumstances. Bidders are strongly advised to submit their bids well in advance of the closing time to avoid any last-minute issues.
- Date and Time for Tender Form Opening: March 03, 2025, 02:00 PM. The tender opening will take place publicly at the TMA Barikot office, commencing at 2:00 PM on the same day of submission deadline. Bidders or their authorized representatives are welcome to attend the tender opening process to ensure transparency and witness the initial stages of bid evaluation.
Bidding Basis and Financial Details: Understanding the Contract Award System
This tender process will utilize the Above/Below/At Par System based on the Market Rate System 2024 (MRS-2024) for contract award. This system is designed to ensure fairness and transparency in the financial evaluation of bids. Key financial aspects of the tender include:
- Contract Award on MRS-2024: The award of contracts will be based on the MRS-2024, First Bi-Annual schedule of rates. Bidders are required to quote their bids as a percentage above, below, or at par with the Engineer’s Estimate, which is derived from the MRS-2024. This “Above/Below/At Par” system simplifies bid comparison and ensures that contract awards are based on current market prices.
- Earnest Money (Bid Security): A mandatory Earnest Money deposit, also known as Bid Security, is required for each scheme to ensure bidder commitment and seriousness. The Earnest Money is set at 2% of the Engineer’s Estimated Cost for each scheme. This bid security must be submitted in the form specified in the tender documents and will be forfeited if the successful bidder fails to execute the contract or comply with tender terms.
- Additional Security for Bids Below Estimate: To safeguard public funds and ensure project viability, a tiered system of Additional Security is in place for bids quoted below the Engineer’s Estimate:
- Bids up to 10% Below Engineer Estimate: Bidders quoting up to 10% below the Engineer’s Estimate are required to submit only the standard 2% Bid Security.
- Bids Between 10% and 20% Below Engineer Estimate: Bidders quoting between 10% and 20% below the Engineer’s Estimate must submit an additional 6% Security (totaling 8% security) of the Engineer’s Estimated cost, in addition to the standard 2% Bid Security. Failure to submit this additional security will render the bid non-responsive, and the initial 2% Bid Security may be forfeited.
- Bids More Than 20% Below Engineer Estimate: Bidders quoting more than 20% below the Engineer’s Estimate are required to submit Additional Security equal to the differential amount between their submitted bid and the Engineer’s Estimate. Furthermore, bids in this category must be accompanied by a detailed Rate Analysis justifying the significantly lower bid price. Bids lacking the detailed rate analysis or the required additional security will be considered non-responsive, and all submitted securities may be forfeited.
- Release of Additional Security in Installments: To facilitate cash flow for contractors while ensuring project progress, the Additional Security submitted for bids below the Engineer’s Estimate will be released in four installments, linked to project completion milestones:
- 1st Installment (25% of Additional Security): Released upon completion of 25% of the project work.
- 2nd Installment (25% of Additional Security): Released upon completion of 50% of the project work.
- 3rd Installment (25% of Additional Security): Released upon completion of 75% of the project work.
- 4th Installment (25% of Additional Security): Released upon 100% completion of the project work.
Eligibility Criteria and Required Documentation: Ensuring Qualified Bidders
To ensure that only capable and compliant contractors participate in these important developmental projects, specific eligibility criteria and required documentation have been established:
- Government Approved and Registered Contractors/Firms: Bidding is open only to contractors and firms that are approved and registered with the Government, specifically with the Local Government, Elections & Rural Development Department Local Council Board, Khyber Pakhtunkhwa.
- License Renewal for 2024-25: Eligible contractors and firms must have renewed their licenses for the fiscal year 2024-25 with the aforementioned Local Council Board. This ensures that participating entities are currently authorized and in good standing with the relevant regulatory body.
- Compulsory Documents to be Submitted with Tender Form: Bidders are required to submit the following documents in sealed envelopes along with their tender forms:
- Fresh Registration of LCB (Local Council Board): A copy of the fresh registration certificate from the Local Council Board for the current financial year (2024-25) is mandatory.
- Fresh Registration of KP Revenue Authority (KPRA): A copy of the fresh registration certificate from the Khyber Pakhtunkhwa Revenue Authority (KPRA) for the current financial year (2024-25) is also mandatory, demonstrating compliance with provincial tax regulations.
- Bill of Quantities (BOQ) Duly Signed and Stamped: The original Bill of Quantities (BOQ) document, obtained from TMA Barikot, must be completely filled out, signed, and officially stamped by the authorized representative of the bidding contractor/firm on each page.
- Owner’s CNIC Copy (Attested): A clearly legible and attested copy of the Computerized National Identity Card (CNIC) of the owner or head of the firm. The CNIC copy must be attested by a government officer of Grade 17 or above.
- Active NTN/Income Tax Certificate: A copy of the valid and active National Tax Number (NTN) certificate and Income Tax Certificate is required to demonstrate tax compliance and registration with the Federal Board of Revenue (FBR).

- Non-Responsive Bids: Bids that are not compliant with the terms and conditions outlined in this tender notice, or are incomplete, or contain cutting/overwriting on the BOQ, or lack required documents or securities, will be declared non-responsive and may be rejected.
- Procuring Entity’s Discretion: The Procuring Entity, TMA Barikot, reserves the right to reject any or all bids at any stage of the tender process, prior to contract award, as per the Khyber Pakhtunkhwa Public Procurement Regulatory Authority (KPPRA) rules. The Procuring Entity is also entitled to re-advertise the procurement opportunity if deemed necessary.
- Fund Availability Contingency: The issuance of work orders and the commencement of work on these schemes are explicitly subject to the availability of funds. The tender process is initiated in anticipation of fund allocation, but actual project execution is contingent upon fund release by the relevant authorities.
- Tax Deductions: All applicable taxes and duties, as per Government laws, will be deducted at source from contractor invoices and payments.
- Equal Offers Resolution: In the event of equal financial offers from multiple bidders, the contract award will be decided through a free toss (draw of lots). This method is employed to ensure fairness and impartiality in resolving tie bids.
- No Cutting or Overwriting: Bids with any cutting or overwriting on the Tender Form or BOQ will be rejected and declared non-responsive. Bidders are urged to fill out these documents meticulously and without errors.
- Future Regulations: Any future rules, regulations, instructions, or guidelines issued by the Provincial Government of Khyber Pakhtunkhwa related to procurement will be automatically applicable to this tender.

- تخمینہ سے کم بولیوں کے لیے اضافی سیکیورٹی: عوامی فنڈز کے تحفظ اور پروجیکٹ کے قابل عمل ہونے کو یقینی بنانے کے لیے، انجینئر کے تخمینے سے کم بولیوں کے لیے اضافی سیکیورٹی کا ایک درجہ بندی والا نظام موجود ہے:
- انجینئر کے تخمینے سے 10% تک کم بولیاں: انجینئر کے تخمینے سے 10% تک کم بولی دینے والے بولی دہندگان کو صرف معیاری 2% بولی کی ضمانت جمع کرانا ہوگی۔

- حکومت سے منظور شدہ اور رجسٹرڈ ٹھیکیدار/فرم: بولی صرف ان ٹھیکیداروں اور فرموں کے لیے کھلی ہے جو حکومت، خاص طور پر محکمہ بلدیات، انتخابات اور دیہی ترقی لوکل کونسل بورڈ، خیبر پختونخوا کے ساتھ منظور شدہ اور رجسٹرڈ ہیں۔
- 2024-25 کے لیے لائسنس کی تجدید: اہل ٹھیکیداروں اور فرموں کے پاس مذکورہ لوکل کونسل بورڈ کے ساتھ مالی سال 2024-25 کے لیے اپنے لائسنس کی تجدید ہونی چاہیے۔ یہ یقینی بناتا ہے کہ حصہ لینے والے ادارے فی الحال مجاز ہیں اور متعلقہ ریگولیٹری ادارے کے ساتھ اچھی ساکھ رکھتے ہیں۔

- ایل سی بی (لوکل کونسل بورڈ) کی تازہ رجسٹریشن: موجودہ مالی سال (2024-25) کے لیے لوکل کونسل بورڈ سے تازہ رجسٹریشن سرٹیفکیٹ کی کاپی لازمی ہے۔
- کے پی ریونیو اتھارٹی (کے پی آر اے) کی تازہ رجسٹریشن: موجودہ مالی سال (2024-25) کے لیے خیبر پختونخوا ریونیو اتھارٹی (کے پی آر اے) سے تازہ رجسٹریشن سرٹیفکیٹ کی کاپی بھی لازمی ہے، جو صوبائی ٹیکس قوانین کی تعمیل کا مظاہرہ کرتی ہے۔

مندرجہ بالا کے علاوہ، بولی دہندگان کو ان شرائط و ضوابط کو بھی مدنظر رکھنا چاہیے جو اس ٹینڈر کے عمل پر حکمرانی کرتے ہیں:
- ٹینڈر دستاویزات کا حصول: ٹینڈر فارمز اور بی او کیوز TMA باریکوٹ کے دفتر سے نیلامی کے لیے دعوت نامہ (NIT) اخبارات میں شائع ہونے کے بعد حاصل کیے جا سکتے ہیں۔ دلچسپی رکھنے والے بولی دہندگان کو مشورہ دیا جاتا ہے کہ وہ ٹینڈر دستاویزات حاصل کرنے اور بولی جمع کرانے کی آخری تاریخ سے پہلے کسی بھی مزید وضاحت کے لیے TMA باریکوٹ کے دفتر کا دورہ کریں۔ رابطہ کی معلومات نیچے دی گئی ہے۔

- فنڈز کی دستیابی کا حادثاتی ہونا: ورک آرڈرز کا اجراء اور ان اسکیموں پر کام کا آغاز واضح طور پر فنڈز کی دستیابی سے مشروط ہے۔ ٹینڈر کا عمل فنڈز کی تقسیم کے اندازے میں شروع کیا جاتا ہے، لیکن پروجیکٹس کا اصل نفاذ متعلقہ حکام کی جانب سے فنڈز کے اجراء پر منحصر ہے۔
- ٹیکس کٹوتی: سرکاری قوانین کے مطابق قابل اطلاق تمام ٹیکسز اور ڈیوٹیز ٹھیکیدار کے انوائسز اور ادائیگیوں سے منبع پر کاٹے جائیں گے۔

- مستقبل کے ضوابط: خیبر پختونخوا کی صوبائی حکومت کی جانب سے خریداری سے متعلق مستقبل میں جاری ہونے والے کوئی بھی قواعد، ضوابط، ہدایات، یا رہنما اصول خود بخود اس ٹینڈر پر لاگو ہوں گے۔
